TERMS OF SERVICE

1. AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Missouri Young Democrats ("MOYD," "we," "us," or "our") governing your access to and use of:
Our websites, including moyoungdemocrats.org, moyd.app, and any subdomains (collectively, the "Sites")
Our mobile applications
Our member portal and CRM system
Our email communications and newsletters
Our Slack workspace and communication platforms
Our events and programs
Any other services we provide (collectively, the "Services")
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services. If you are using the Services on behalf of an organization (such as a chapter), you represent and warrant that you have the authority to bind that organization to these Terms.
2. ABOUT
Missouri Young Democrats is a 527 political organization registered with the Internal Revenue Service. We are the official youth arm of the Missouri Democratic Party, dedicated to engaging young people ages 14-35 in the democratic process and building the next generation of Democratic leaders.
Our affiliated organizations include:
College Democrats of Missouri
High School Democrats of Missouri
County Young Democrats chapters throughout Missouri
3. ELIGIBILITY
3.1 Age Requirements
To use our Services, you must meet the following age requirements:
Missouri Young Democrats General Membership: You must be between 14 and 35 years of age.
High School Democrats of Missouri: You must be a current high school student, typically between 14 and 18 years of age.
College Democrats of Missouri: You must be a current student at an accredited college or university in Missouri.
Website and Newsletter Access: There is no minimum age to browse our public websites or subscribe to newsletters, though we do not. knowingly collect information from children under 13.
3.2 Geographic Requirements
Full membership in Missouri Young Democrats requires that you either:
Reside in Missouri, OR
Attend a college or university in Missouri
3.3 Account Registration
When you create an account or register as a member, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access
3.4 One Account Per Person
You may maintain only one member account. Creating multiple accounts may result in termination of all accounts.
4. MEMBERSHIP
4.1 Membership Types
MOYD offers several membership categories:
Individual Members: Young Democrats ages 14-35 who register directly with MOYD
Chapter Members: Members who join through a chartered college, high school, or county chapter
At-Large Members: Members who reside in areas without active local chapters
Associate Members: Individuals outside the age range who wish to support MOYD (non-voting)
4.2 Membership Benefits
Active members in good standing may be entitled to:
Voting rights in organizational elections
Eligibility to hold office
Access to member-only events and programming
Access to the member portal and digital resources
Chapter affiliation
Committee participation opportunities
Connection to state and national Young Democrat networks
4.3 Membership Obligations
As a member, you agree to:
Support the principles and platform of the Democratic Party
Abide by MOYD's Constitution, Bylaws, and policies
Conduct yourself in a manner that reflects positively on the organization
Pay any required dues in a timely manner
Participate in good faith in organizational activities
4.4 Membership Termination
Your membership may be suspended or terminated for:
Violation of these Terms or organizational policies
Conduct detrimental to the organization
Supporting candidates or parties opposed to the Democratic Party
Non-payment of dues (where applicable)
Reaching the age limit for membership
Upon your written request
Termination procedures are governed by MOYD's Constitution and Bylaws.
5. ACCEPTABLE USE POLICY
5.1 Permitted Uses
You may use our Services for:
Engaging with MOYD programs and activities
Communicating with other members and leadership
Accessing organizational resources and information
Participating in Democratic Party activities
Volunteer coordination and political organizing
Educational and professional development
5.2 Prohibited Conduct
You agree NOT to:
Use the Services for any unlawful purpose or in violation of any laws
Harass, abuse, threaten, or intimidate other users or members
Post or transmit content that is defamatory, obscene, violent, hateful, or discriminatory
Impersonate any person or entity or misrepresent your affiliation
Interfere with or disrupt the Services or servers
Attempt to gain unauthorized access to any portion of the Services
Use automated means (bots, scrapers, etc.) to access the Services without our written permission
Collect or harvest personal information about other users
Use the Services to send spam or unsolicited communications
Upload viruses, malware, or other malicious code
Circumvent any security measures or access controls
Use the Services to support candidates or organizations opposed to the Democratic Party
Engage in any activity that could damage, disable, or impair the Services
Violate any applicable laws, regulations, or third-party rights
Share login credentials or allow others to access your account
5.3 Slack Workspace Guidelines
Our Slack workspace is a professional communication tool. When using Slack, you agree to:
Keep discussions relevant to channel topics
Treat all members with respect and professionalism
Refrain from sharing confidential or sensitive information inappropriately
Follow channel-specific guidelines set by moderators
Report violations to workspace administrators
Not use Slack for commercial solicitation unless approved
5.4 Event Conduct
When attending MOYD events (in-person or virtual), you agree to:
Follow all event rules and instructions from organizers
Treat other attendees, speakers, and staff with respect
Not engage in disruptive behavior
Comply with venue rules and requirements
Not record sessions without permission where prohibited
6. USER CONTENT
6.1 Definition
"User Content" means any content you submit, post, or transmit through our Services, including text, images, comments, messages, profile information, and any other materials.
6.2 Your Responsibilities
You are solely responsible for your User Content. By submitting User Content, you represent and warrant that:
You own or have the necessary rights to the content
The content does not infringe any third-party rights
The content complies with these Terms and applicable laws
The content is accurate and not misleading
6.3 License to MOYD
By submitting User Content, you grant MOYD a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content throughout the world in any media for purposes related to MOYD's mission and activities.
6.4 Content Moderation
We reserve the right, but are not obligated, to:
Review, monitor, or moderate User Content
Remove or disable access to any User Content that violates these Terms
Take appropriate action against users who violate these Terms
6.5 No Obligation to Store
We are not obligated to store, maintain, or provide copies of any User Content. You are responsible for maintaining your own backups.
7. INTELLECTUAL PROPERTY
7.1 MOYD Property
The Services and their contents, features, and functionality are owned by Missouri Young Democrats and are protected by copyright, trademark, and other intellectual property laws. This includes:
Our name, logos, and branding
Website design and layout
Software and code
Text, graphics, and images we create
Training materials and resources
Databases and data compilations
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes, subject to these Terms.
7.3 Restrictions
You may not:
Reproduce, distribute, or publicly display our content without permission
Modify, create derivative works from, or reverse engineer our Services
Use our trademarks or branding without written authorization
Remove any copyright or proprietary notices
Use our content for commercial purposes without permission
7.4 Trademarks
"Missouri Young Democrats," "MOYD," "College Democrats of Missouri," "High School Democrats of Missouri," and associated logos are trademarks of Missouri Young Democrats. You may not use these marks without our prior written consent.
7.5 Feedback
If you provide us with feedback, suggestions, or ideas regarding the Services, you grant us the right to use such feedback without any obligation to you.
8. DONATIONS & PAYMENTS
8.1 Donation Processing
Donations to Missouri Young Democrats are processed through ActBlue, a third-party payment processor. By making a donation, you agree to ActBlue's terms of service in addition to these Terms.
8.2 Use of Donations
Donations are used to support MOYD's mission, including:
Organizational operations and administration
Events and programming
Outreach and communications
Leadership development
Political organizing activities
8.3 Tax Status
Missouri Young Democrats is a Political Action Committee registered with the Missouri Ethics Commission. Contributions to MOYD are not tax-deductible as charitable contributions for federal or state tax purposes
8.4 Contribution Limits and Reporting
As a Political Action Committee, we are required to report certain donor information to the Missouri Ethics Commission. Donors should be aware that their names, addresses, and contribution amounts may become part of public records.
8.5 Refunds
Donations are generally non-refundable. If you believe a donation was made in error, please contact us at info@moyoungdemocrats.org within 90 days.
8.6 Recurring Donations
If you set up a recurring donation, you authorize us (through ActBlue) to charge your payment method on a recurring basis. You may cancel recurring donations at any time through ActBlue or by contacting us.
9. EVENTS & PROGRAMS
9.1 Event Registration
By registering for MOYD events, you agree to:
Provide accurate registration information
Pay any applicable registration fees
Abide by event rules and this Acceptable Use Policy
Assume responsibility for your own safety and belongings
9.2 Photography and Recording
MOYD may photograph, video record, or audio record events, meetings, and any type of official and unofficial programming for promotional, educational, and archival purposes. By attending such events, you consent to being photographed or recorded and grant MOYD the right to use such materials without compensation. If you do not wish to be photographed or recorded, please notify event staff upon arrival.
9.3 Event Cancellation
We reserve the right to cancel, postpone, or modify events. In case of cancellation, we will make reasonable efforts to notify registrants and provide refunds for paid events where applicable.
9.4 Liability Waiver
By attending MOYD events, you acknowledge that participation involves certain risks and agree to release MOYD, its officers, volunteers, and affiliated organizations from liability for any injuries or damages arising from your participation, except to the extent caused by our gross negligence or willful misconduct.
10. CHAPTERS
10.1 Chapter Status
Chapters (college, high school, and county) operate as affiliated entities of Missouri Young Democrats. Chapters must maintain a valid charter and comply with MOYD's Constitution, Bylaws, and chartering requirements.
10.2 Chapter Obligations
Chartered chapters agree to:
Operate in accordance with MOYD's Constitution and Bylaws
Submit required reports and documentation
Maintain minimum membership and activity requirements
Use MOYD branding in accordance with our guidelines
Support Democratic candidates and the Democratic Party platform
Participate in state organization activities
10.3 Charter Revocation
MOYD reserves the right to revoke a chapter's charter for:
Violation of MOYD's Constitution, Bylaws, or policies
Failure to meet chartering requirements
Conduct detrimental to the organization
Supporting non-Democratic candidates or parties
Inactivity or failure to maintain minimum requirements
11. COMMUNICATIONS
11.1 Electronic Communications
By providing your email address or phone number, you consent to receive electronic communications from us, including:
Newsletters and organizational updates
Event announcements and reminders
Political action alerts
Administrative communications about your account or membership
Donation receipts and acknowledgments
11.2 Text Messages
If you opt in to receive SMS/RCS/iMessage messages, standard message and data rates may apply. You can opt out at any time by replying STOP.
11.3 Communication Preferences
You may manage your communication preferences through your account settings or by contacting us. Note that certain administrative communications cannot be opted out of while you maintain an active account.
12. THIRD-PARTY SERVICES
12.1 Third-Party Services
Our Services integrate with or link to third-party services, including:
ActBlue (donations)
Google Workspace
Slack
Social media platforms
Event registration platforms
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
12.2 Links
Our Services may contain links to third-party websites. We do not endorse or assume responsibility for any third-party sites, information, materials, or services.
13. DISCLAIMERS
13.1 "As Is" Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
13.2 No Guarantees
WE DO NOT WARRANT THAT:
• The Services will be uninterrupted, secure, or error-free
• Any errors will be corrected
• The Services will meet your requirements
• The results obtained from using the Services will be accurate or reliable
13.3 Political Outcomes
MOYD makes no representations or warranties regarding the outcome of any political campaigns, elections, or advocacy efforts. Political outcomes depend on many factors beyond our control.
14. LIMITATION OF LIABILITY
14.1 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MISSOURI YOUNG DEMOCRATS, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:
Your access to or use of (or inability to access or use) the Services
Any conduct or content of any third party on the Service
Any content obtained from the Services
Unauthorized access, use, or alteration of your content or data
14.2 Cap on Liability
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO MOYD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
14.3 Basis of the Bargain
THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US.
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Missouri Young Democrats, its officers, directors, employees, volunteers, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use of the Services
Your violation of these Terms
Your violation of any rights of any third party
Your User Content
Your participation in MOYD activities
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before filing any formal dispute, you agree to first contact us at info@moyoungdemocrats.org to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving notice.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
16.3 Venue
Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Missouri, and you consent to the jurisdiction of such courts.
16.4 Time Limitation
Any cause of action or claim you may have arising out of or relating to these Terms or the Services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
17. TERMINATION
17.1 Termination by You
You may terminate your account at any time by:

17.2 Termination by Us
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including for:
Violation of these Terms
Conduct harmful to the organization or other users
Extended inactivity
At our sole discretion
17.3 Effect of Termination
Upon termination:
Your right to use the Services will immediately cease
We may delete your account and User Content
Provisions that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
18. GENERAL PROVISIONS
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and MOYD regarding the Services.
18.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
18.5 Notices
Notices to you may be made via email to the address associated with your account or by posting on our Sites. Notices to us should be sent to info@moyoungdemocrats.org.
18.6 Force Majeure
We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
18.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.

19. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Update the "Last Updated" date at the top of these Terms
Post a notice on our Sites
Notify registered users via email (for significant changes)
Your continued use of the Services after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

21. SPECIAL PROVISIONS
21.1 Parental Awareness
If you are under 18, we encourage you to review these Terms with a parent or guardian before using our Services.
21.2 High School Democrats
High School Democrats of Missouri members and their parents/guardians should be aware that participation in political organizing activities may involve public engagement, attendance at political events, and communications about political issues.
21.3 Parental Rights
Parents or guardians of minor members may contact us to:
Review information we have collected about their child
Request deletion of their child's information
Withdraw consent for their child's participation
ACKNOWLEDGMENT
BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICES.
